SHANGHAI, Mar. 14 (Xinhua) -- Shanghai High People’s Court will set up a normalized judicial data disclosure platform on its website to regularly and dynamically publish relevant data of case acceptance, conclusion and enforcement of the three-level courts of Shanghai and progress information of litigation processes such as case acceptance, payment, trial, and judgment, etc..

Such a move is made in accordance with the provisions of the Several Provisions of the Shanghai High People’s Court on the Disclosure of Relevant Judicial Data on the Internet (Trial) and the Several Provisions of the Shanghai High People’s Court on Online Filing, Electronic Delivery, and Electronic Filing (Trial) issued earlier by the Shanghai High People’s Court.

According to the Shanghai High People’s Court, the judicial data to be revealed stems from the Shanghai court trial process management system and is automatically captured and sorted by computer.  The data will be monthly checked by relevant courts and trial lines to ensure the accuracy. At present, the judicial data on commercial, financial and land-related disputes closely related to the business environment has been tentatively published in advance.

In addition, if an online filing case meets the conditions for online case filing, the people’s court shall register and file the case. In such case, a notice of payment of the litigation fee is generated online and sent to the plaintiff; and the plaintiff may not bother to further submit a paper indictment. Before the new provisions are enacted, although the involved parties needs only to submit the electronic indictment at the filing stage to complete online filing, the trial business court usually still requires the plaintiff to submit a paper indictment in accordance with the traditional filing requirement that the original documents should be collected.

In contrast, according to the new provisions, electronic documents filed by the parties during litigation and generated during the trial procedures will be electronically archived by the courts in an instant electronic filing system. This solves the past problem that electronic litigation materials cannot be archived, and truly realizes “complete paperless” online filing.
